The affixing of air conditioners on the perimeter walls pursuant to art. 1117, n. 1, civil code are among the common goods, in principle, does not require any type of assembly authorization as it falls within the terms of art. 1102 cc ("each participant can use the common thing, provided that it does not alter its destination and does not prevent the other participants from making equal use of it according to their right") although, however, having to coordinate in addition to the limits indicated in the aforementioned article, even with the limits of the prohibition to alter the architectural decoration of the building provided for in terms of innovations by art. 1120, 2nd cc (sentence no. 12343/2003).

From the combined provisions of the two articles ", the owners of the real estate units can use the common walls, provided that the exercise of this faculty, governed by articles 1102 and 1120 of the civil code, does not affect the stability and architectural decoration of the building" 

The assessment of the violation of these limits (statics, aesthetics, and decorum of the building) is however left to the judgment of the judge and not to the discretion of the individual condominium or the assembly, much less the administrator.

These may, if they believe that such violations of the limits exist, take legal action to have the asset removed especially if, as in the case described, it is a matter of air conditioners of considerable size (such as not being able to be placed on the private terrace of the condominium), for which, however, the principle of art. 1102 cited, (i.e. the possibility of being installed on an external wall of the building) and it will be the judge who, given their mammoth size and the immediate vicinity of some windows, will be able to have it removed with the restoration of the ex-ante situation, should he consider, in his opinion, this affixing is prejudicial to the aesthetics of the building or for exceeding the limits of normal tolerability referred to in 844 of the Italian Civil Code on the subject of noise inputs.
